These Terms, their subject matter and its formation (and any non-contractual disputes or claims) are governed by Bulgarian law. We both agree to the exclusive jurisdiction of the courts of Bulgaria.

Please read this document carefully as it contains the terms and conditions that you agree to be bound by if you continue to use Percenta Online Store. The below terms and conditions (“the Conditions”) and the Terms of Use apply to your use of this Online Store and to any purchases you make through Percenta Online Store.
In the event of any conflict between the Terms of Use and these Conditions, the latter shall prevail. These Conditions and the Terms of Use apply between you and Percenta Ltd. (“Percenta”, “we” or “us”), whose registered office is at 2B Dimitar Talev str., 4004 Plovdiv, Bulgaria. Please address any complaints, queries or correspondence regarding these conditions or Percenta Online Store, to the contacts as listed in our contact us page. This site is operated by Percenta Ltd. (registered number 205253874, VAT number BG205253874) from its registered address at 2B Dimitar Talev str., 4004 Plovdiv, Bulgaria.
Purchasing the Percenta Products
Eligibility to order criteria: You may only purchase products from Percenta Online Store:
- Available for sale and details of which appear on Percenta Online Store;
- For delivery and
- For personal use, either by yourself or by your intended recipient(s) of the products.
Details of the products available for purchase (including their price) are set out on Percenta Online Store. Percenta takes all reasonable care to ensure that all details, descriptions and prices of products appearing on Percenta Online Store are correct at the time when the relevant information is placed onto Percenta Online Store. Although every effort is made to keep Percenta Online Store as up to date as possible, the information appearing at a particular time may not always reflect the position exactly at the moment you place an order. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect price.
Ordering Products
Once you have selected the products you wish to order, navigated through the checkout process and clicked on the ‘Submit Order’ button on the cart page.
Once you have clicked on the ‘Submit Order’ button, you have made a binding offer for the sale of goods. Your offer at this stage is still subject to our acceptance. In order that we may accept your offer, we obtain an authorisation from your Credit card company for the amount detailed on the order summary page. We are not taking funds from your card at this stage, although the amount available for you to spend will be reduced by the authorisation. This is a normal process with the banks. If your credit card should not give an authorisation, your order will not be processed further.
Percenta will email you to confirm your product order has been received.
Percenta will email you again to confirm that the products you have ordered are being shipped to you.
We are deemed to have accepted your offer, and a corresponding contract of sale for the products you have ordered is concluded between you and Percenta Online Store only upon those products being shipped to you, as detailed in the dispatch confirmation e-mail.
Percenta may refuse or be unable to process your order if:
- The product you ordered is discontinued or no longer available.
- Your credit card does not give authorisation for the payment of the purchase price
- You do not meet the eligibility to order criteria set out above.
- You want to ship to a freight forwarding company address for example Self Storage, Address Pal and Storage Wizard as they are unable to accept delivery.
- Percenta will not be liable to you for any loss or damage directly or indirectly resulting from such refusal or inability to process your order.
Cancelling The Contract and Returns
Order Cancellation and Returns
You are entitled to cancel your order if you change your mind, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services. This doesn’t affect or limit your statutory rights if goods are faulty or not as described.
When returning goods as part of an order cancellation, we will refund:
- the full purchase price
- the delivery charges (the cost for initial delivery to you)
Important note: If you choose to cancel your order you will be expected to return the goods in your order to us in the same condition in which you received them.
The returned product must be unused, unopened, in good condition, and in its original, undamaged packaging, including all original labels, accessories, and additional components. This includes goods which may have been sent to you for free as part of a gift promotion. These must also be returned to us for us to process your full order refund.
Except where goods are faulty, Percenta will NOT refund the return delivery charges (cost for returning goods to us) and if you fail to return goods to us we may charge you for the cost incurred in collecting them from you.
You will need to send the goods back to Percenta within 14 days after the day on which you cancelled your order (we do not need to receive them within 14 days; you just need to have sent them off to us within that time).
Damaged Or Faulty Products and Incorrect Orders
You may exchange your goods or obtain a full refund if the goods in your order are damaged or faulty upon receipt, or if the goods you have received are not the goods you originally ordered. When returning damaged, faulty or incorrect orders we will refund:
- Full Purchase Price
- Delivery Charges (the cost for initial delivery to you)
- Return Charges (the cost for returning goods to us) upon the production of a receipt. Alternatively we will arrange to collect your goods from you at our cost
When exchanging damaged, faulty or incorrect orders we will:
- Dispatch replacement items to you free of charge
- Refund return charges (the cost for returning goods to us) upon production of a receipt. Alternatively we will arrange to collect your goods from you at our cost
We are under a legal duty to supply products that are in conformity with this contract and nothing in these terms will affect your legal rights.
How To Return Your Goods
You may return goods purchased on The Body Shop Online store by contacting us.
The following information will be required when returning your goods:
• Confirmation Email containing your Transaction Reference Number
• Delivery Documentation containing your Delivery Number, with the following sections completed:
1. List and description of goods to be returned
2. Reason given for returning goods
• Reasonable care must be taken when packaging the parcel and returning it so that goods are not damaged in transit
• You are advised to use a carrier that offers both traceability and insurance to ensure that the returned good will arrive back with us to enable us to process the return.

Liability
The Products are supplied for domestic and private use only. Percenta shall not be liable for any losses relating to any business of yours, for example, lost revenue, income or profits, lost data or any interruption to your business. You must follow any instructions we may give you in relation to the safe use or storage of the Products. Subject to applicable law, we will not be responsible for any damage to the Products which is caused by your failure to follow these instructions. There are certain responsibilities which Percenta cannot exclude by law and nothing in these Terms and Conditions of Sale limits or attempt to limit our to you:
- for death or personal injury resulting from negligence.
- Fraud
General
Percenta reserves the right to:
- Modify or withdraw, temporarily or permanently, Percenta Online Store (or any part thereof, including product images or concerning the availability of products) with or without notice to you; Percenta shall not be liable to you or any third party for any such modification or withdrawal; and/or
- Change the Conditions from time to time, and your continued use of The Body Shop Online Store (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using Percenta Online Store.
- If Percenta should change these Conditions, your order will be subject to the Terms and Conditions that were in force at the Date and time of you placing your order. Copies of the applicable past T&C are available by email.

Shipping Destinations
- We currently ship to the countries listed at checkout.

Processing Time
- Orders are processed within 8 business days (excluding weekends and public holidays) after payment confirmation.
- If there is a delay due to high order volume, we will notify you via email.
- Custom or personalized orders may require additional processing time.
Shipping Methods & Delivery Time
We offer different shipping options depending on your location:
- Zone 1: Shipping method – Express DAP (Delivered At Place) shipping by UPS; Estimated delivery time – 1-2 business days; Cost – 4.95 EUR, Free shipping on all orders that exceed 100 EUR
- Zone 2: Shipping method – Express DAP (Delivered At Place) shipping by UPS; Estimated delivery time – 1-5 business days; Cost – 9.95 EUR, Free shipping on all orders that exceed 130 EUR
- Zone 3: Shipping method – Express DAP (Delivered At Place) shipping by UPS; Estimated delivery time – 2-7 business days; Cost – 14.95 EUR, Free shipping on all orders that exceed 160 EUR
- Delivery times are estimates and may vary due to external factors (e.g., customs processing, weather conditions, carrier delays).
- Once your order is shipped, you will receive a tracking number to monitor your shipment status.
- Shipping costs are calculated at checkout based on your location and selected shipping method.
Customs, Regulations, Duties & Taxes
- International orders may be subject to customs duties, import taxes, or fees imposed by the destination country.
- Shipping costs do not include import duties, local taxes, or fees applicable in the destination country. Any customs charges, taxes, or additional fees are the responsibility of the recipient.
- It is the recipient’s responsibility to check local import regulations and requirements before placing an order. As the sender, we are not responsible for any additional customs rules, document requirements, or restrictions imposed by the destination country.
- Delays due to customs processing are beyond our control.
Order Tracking
- Once your order is dispatched, you will receive a confirmation email and a tracking number.
- You can track your shipment using the carrier’s website or our tracking portal.
- If you do not receive your tracking details, please contact our support team.
Lost, Stolen, or Damaged Packages
- We are not responsible for lost or stolen packages once marked as delivered.
- If your package is damaged upon arrival, please contact us immediately with photos of the damage.
- For lost packages, please reach out to our support team, and we will assist you in filing a claim with the carrier.
Undeliverable Packages & Address Errors
- If a package is returned due to an incorrect or incomplete address, the customer is responsible for reshipping costs.
- If a package is refused or unclaimed, we reserve the right to charge a restocking fee or deduct return shipping costs from the refund.
Order Refusal and Return
- If a customer refuses to accept a shipment after it has already been dispatched and/or marked as completed, the shipment will either be returned to us at our discretion or destroyed in the destination country or another country along the transit route. In both cases, we are released from any responsibility to deliver the ordered products.
- If the shipment is returned to us, the customer is responsible for any additional costs incurred, including but not limited to return shipping fees, additional handling fees, customs duties, and other applicable charges. In this case, we are released from the obligation to deliver the ordered products, and the customer will receive a refund for the paid amount after deducting all actual expenses, including but not limited to shipping, transportation, insurance, customs processing, and any other costs incurred for dispatching and returning the shipment.
- If the customer refuses to accept a shipment after it has been dispatched, and the shipment is destroyed in the destination country or another country along the transit route, we are released from any responsibility to deliver the ordered products, and the customer is not entitled to receive any refund.
If, at the time of receiving the shipment or prior to that, the customer identifies any discrepancies in the accompanying documents, declared customs value, additional charges, or any other issues, the customer is required to notify us immediately so that we can address and resolve the issue. If the customer accepts the shipment despite the discrepancies, declares to the courier company that they refuse the delivery, or fails to take timely action, which affects our ability to assist and resolve the issue, we are released from any responsibility to resolve the matter.
Shipping Restrictions
- We do not ship to P.O. boxes or military addresses in certain regions.
- Some products may have specific shipping restrictions due to hazardous materials or regulations.

Right of Withdrawal
Pursuant to applicable consumer protection laws, customers have the right to withdraw from their purchase within fourteen (14) days from the date of receipt of the goods. To exercise this right, the customer must notify us in writing before the expiration of the 14-day period by sending an email containing a clear and unambiguous statement of their intent to return the purchased product. Upon receipt of this notification, we will provide detailed instructions on the return process. Once the withdrawal has been communicated, the customer is required to return the product to the designated return address within fourteen (14) days from the date of notification.
Return Conditions
To be eligible for a refund, the returned product must meet the following conditions:
- The product must be unused, unopened, in good condition, and in its original, undamaged packaging, including all labels, accessories, and additional components.
- Any complimentary gifts or free accessories provided with the order must also be returned.
- If the product has been used, damaged, or its packaging has been compromised, a deduction may be applied to the refund amount to compensate for depreciation.
Refund Process
Once the returned product has been received and inspected to confirm compliance with the return conditions, a refund will be processed within fourteen (14) days. Refunds will be issued using the same payment method as the original transaction. Please note that return shipping costs are borne by the customer in all cases.
Warranty & Defective Products
We endeavor to deliver all products in perfect condition. However, in the event of damage or defects, the following procedures apply:
1. Inspection Upon Delivery
- Customers are advised to inspect their packages immediately upon receipt. If any damage is detected, the customer must contact us without delay, providing a description of the issue along with clear photographic evidence of the damaged packaging and/or product.
- If the package shows visible signs of damage at the time of delivery (e.g., torn or punctured packaging), the customer should note such observations on the courier’s delivery receipt before accepting the package.
- To ensure prompt resolution, all damage or discrepancies must be reported immediately upon receipt of the package.
2. Reporting a Defective Product
- If a product is found to be defective (e.g., a non-functioning spray mechanism), the customer must notify us as soon as possible, but no later than seven (7) days after receipt.
- In cases of damaged shipments, broken products, or other significant issues, immediate notification is required to facilitate compensation and to initiate a claim with the courier service.
3. Replacement & Compensation
- If a claim is deemed valid, we will provide a replacement product at no additional cost to the customer.
- Claims will be reviewed and addressed as promptly as possible to ensure an efficient resolution.
Incorrect or Missing Products
While we make every effort to ensure order accuracy, in the event that incorrect or missing items are received, the following steps should be taken:
- Inspection Upon Delivery
- Customers must check their packages upon receipt. If an incorrect product has been sent or an item is missing, the customer must notify us immediately, providing a description of the discrepancy along with photographic evidence.
- To facilitate a smooth resolution, such issues must be reported within twenty-four (24) hours of delivery.
2. Replacement & Compensation
- If a claim is found to be valid, we will rectify the issue and ship the correct products at no additional cost.
- We will handle such claims expeditiously and endeavor to provide a prompt resolution.
Refund Processing
If a refund is required due to a product return or any other reason, the refund will be issued via the same payment method originally used for the purchase. Refunds will be processed no later than fourteen (14) days from the date of receipt of the returned product or confirmation of the compensation agreement. If a customer requests a refund via a different payment method, such a request must be made in writing via email. In such cases, we reserve the right to verify payment details before processing the refund.

Return shipping costs are the responsibility of the customer, and all returns must be prepaid. We do not accept returns sent via cash on delivery (COD). To ensure a smooth return process, customers must adhere to all return conditions and include all necessary items in the returned package.
